Operativos migratorios, seguros y Tesla: tres asuntos que impactan a contratistas del roofing

Los contratistas operan en un entorno donde las presiones sobre la fuerza laboral, las disputas con aseguradoras y los cambios tecnológicos pueden crear nuevos riesgos con rapidez. En una conversación reciente con Jill Bloom, Trent Cotney, socio de Adams & Reese, analizó varios asuntos que los contratistas deben tener presentes.

Cotney mencionó una encuesta reciente de Associated General Contractors of America (AGC) y el National Center for Construction Education and Research (NCCER), según la cual el 29% de los contratistas de la construcción ha experimentado algún impacto en su fuerza laboral relacionado con las acciones migratorias.

Los efectos pueden incluir auditorías de formularios I-9, operativos del Servicio de Inmigración y Control de Aduanas (ICE) y complicaciones relacionadas con trabajadores subcontratados.

Contratistas del sur del país han reportado algunos de los mayores impactos. Cotney explicó que podrían influir varios factores, entre ellos la construcción durante todo el año en estados como Florida, el auge de los mercados de construcción en el sur y una mayor dependencia de la mano de obra subcontratada en la construcción residencial.

El mensaje para los empleadores es directo: el cumplimiento debe seguir siendo una prioridad.

“Asegurarse de contar con las políticas y los procedimientos correctos y mantener debidamente los formularios I-9; todo eso debe ser prioritario”, dijo Cotney.

Presión sobre los pagos de seguros

Bloom y Cotney también abordaron otro reto conocido para los contratistas de restauración: recibir el pago de las aseguradoras.

Cotney explicó que el entorno de los seguros para trabajos de restauración y daños por tormentas ha cambiado considerablemente durante los últimos cinco años. Florida ha sido el centro de muchas reformas, incluidas modificaciones relacionadas con la publicidad, los avisos obligatorios, la cesión de beneficios y los honorarios de abogados.

Al mismo tiempo, Cotney señaló que los contratistas enfrentan un mayor escrutinio, demoras en los pagos y resistencia por parte de las aseguradoras. El problema afecta a contratistas de roofing, empresas de muros y plafones, y contratistas de mitigación que realizan trabajos de restauración.

Este entorno puede obligar a los contratistas a reconsiderar sus contratos.

Cotney considera que podrían estar por terminar los días en que se dependía exclusivamente de acuerdos contingentes vinculados a los pagos de seguros. En cambio, está observando que los contratistas adoptan acuerdos híbridos que reconocen los fondos del seguro, pero establecen que el propietario o usuario final es, en última instancia, responsable del pago.

Lecciones que dejó lo ocurrido con Tesla Solar

Para los contratistas de roofing, la salida de Tesla del negocio de los techos solares ofrece otra lección sobre la gestión del riesgo a largo plazo.

Cotney recordó el entusiasmo que generaron las tejas solares de Tesla cuando la tecnología llegó hace aproximadamente una década. Ahora, los contratistas que instalaron ese sistema exclusivo deben considerar cómo darán servicio a esos techos en el futuro.

Tesla ha indicado que continuará respetando las garantías existentes y suministrando piezas de repuesto en el futuro previsible, dijo Cotney. Sin embargo, los contratistas deberían considerar mantener inventarios adecuados de las piezas y los suministros necesarios para atender futuros problemas de instalación o de materiales.

La lección va más allá de Tesla. Los contratistas que instalan sistemas exclusivos deben considerar qué ocurriría si un fabricante deja de producir el sistema, cambia de dirección o sale del negocio mientras el contratista todavía mantiene obligaciones de garantía a largo plazo.

Cotney se mantiene optimista en que la energía solar se recuperará a medida que mejore la tecnología y los contratistas y clientes obtengan mayor valor de los componentes solares.

Bloom y Cotney concluyeron destacando a Roofing Alliance y su trabajo en apoyo de becas, investigación, educación e iniciativas de la industria. Cotney mencionó específicamente la colaboración de la organización con Clemson University y alentó a los contratistas a informarse y participar.

El mensaje de Cotney fue constante en los tres temas: los contratistas deben anticiparse a los cambios en lugar de reaccionar cuando ya ocurrieron. Ya sea que el reto involucre mano de obra, contratos, seguros o nuevas tecnologías, la preparación puede marcar la diferencia entre controlar el riesgo y quedar expuesto a él.
